The consumer and user has the right to:

  • Repair or replace. The consumer and user may opt for repair or replacement, unless one of the two options is impossible or disproportionate. The one with a higher cost will be considered disproportionate. Non-fungible goods (when they are of a specific nature) or second-hand goods cannot be replaced. Both repair and replacement must be carried out within a reasonable period of time and completely free of charge for the consumer.
  • Price reduction or termination of the contract. They will proceed when the consumer and user cannot demand the repair or replacement and in cases in which it has not been carried out within a reasonable period of time or without major inconvenience for the consumer and user. The resolution will not proceed when the lack of conformity is of minor importance.

These warranty conditions do not affect the consumer's statutory rights protected by applicable legislation.

For these purposes, YAJAP SL informs that the Revised Text of the General Law for the Defense of Consumers and Users (TRLGDCU) establishes several options to be able to exercise the right of withdrawal. In order to shorten the time and so that you can make the return in a comfortable way and without delays, at Second Chance we advise you to fill out all the information in the form as accurately as possible.

In accordance with current legislation, the contract concluded may be rescinded, without the need to justify such decision and without penalty of any kind, within a period of 14 calendar days from receipt of the merchandise by the customer. To do this, you must fill out the following document: withdrawal form.

The consumer will only be responsible for the decrease in value of the goods resulting from handling them other than that necessary to establish their nature, characteristics or operation.

The right of withdrawal will not be applicable to contracts that refer to:

  1. The provision of services, once the service has been completely executed, when the execution has begun, with prior express consent of the consumer and user and with the recognition on their part that they are aware that, once the contract has been completely executed by the employer, he will have lost his right of withdrawal.
  2. The supply of goods or the provision of services whose price depends on fluctuations in the financial market that the entrepreneur cannot control and that may occur during the withdrawal period.
  3. The supply of goods made in accordance with the specifications of the consumer and user or clearly personalized.
  4. The supply of goods that may deteriorate or expire quickly.
  5. The supply of sealed goods that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery.
  6. The supply of goods that, after delivery and taking into account their nature, have been inseparably mixed with other goods.
  7. The supply of alcoholic beverages whose price has been agreed upon at the time of entering into the sales contract and which cannot be delivered within 30 days, and whose real value depends on market fluctuations that the entrepreneur cannot control.
  8. Contracts in which the consumer and user have specifically requested the businessman to visit them to carry out urgent repair or maintenance operations; If, during that visit, the businessman provides additional services to those specifically requested by the consumer or supplies goods other than the spare parts necessarily used to carry out maintenance or repair operations, the right of withdrawal must apply to said additional services or goods. .
  9. The supply of sealed sound or video recordings or sealed computer programs that have been unsealed by the consumer and user after delivery.
  10. The supply of daily press, periodicals or magazines, with the exception of subscription contracts for the supply of such publications.
  11. Contracts concluded through public auctions.
  12. The supply of accommodation services for purposes other than housing, transportation of goods, vehicle rental, food or services related to leisure activities, if the contracts provide for a specific date or period of performance.
  13. The supply of digital content that is not provided on a material medium when the execution has begun with the prior express consent of the consumer and user with the knowledge on their part that they consequently lose their right of withdrawal.

Once we receive the product(s), we will refund your money according to the payment method you used:

  • If you paid by card , we will credit your account within 48 to 72 hours.
  • If you paid by Paypal , we will make the payment to your Paypal account.
  • If you made the payment by transfer , we will ask you for an account number to make the payment. Keep in mind that it may take up to 48 business hours for it to be reflected in your bank account.
  • For the rest of the payment methods, we will ask you for an account number to make the payment.

You will only be responsible for the decrease in value of the goods resulting from their handling other than that necessary to establish their nature, characteristics or operation.

YAJAP SL offers a two-year warranty from the delivery of the product under the terms and conditions stipulated in accordance with the current legal framework of art. 123.1 RDL 1/2007.

REFUND TERMS:

  1. The seller is responsible for any lack of conformity that appears within a period of two years from delivery. In second-hand products, the seller and the consumer and user may agree on a shorter period, which may not be less than one year from delivery. Unless proven otherwise, it will be presumed that the lack of conformity that appears within six months after the delivery of the product, whether new or second-hand, already existed when the thing was delivered, except when this presumption is incompatible with the nature of the product or the nature of the lack of conformity.
  2. Unless proven otherwise, delivery is deemed to have been made on the day that appears on the invoice or purchase receipt, or on the corresponding delivery note if this is later.
  3. The seller is obliged to deliver to the consumer or user who exercises their right to repair or replacement, documentary justification of the delivery of the product, stating the delivery date and the lack of conformity that causes the exercise of the right.

Likewise, together with the repaired or replaced product, the seller will provide the consumer or user with documentary justification of the delivery stating the date of delivery and, where applicable, the repair carried out.

  1. The action to claim compliance with the provisions of Chapter II of this title will expire three years from the delivery of the product.
  2. The consumer and user must inform the seller of the lack of conformity within two months of becoming aware of it. Failure to comply with said deadline will not entail the loss of the right to the corresponding sanitation, with the consumer and user being responsible, however, for any damages or losses actually caused by the delay in communication.

Unless proven otherwise, it will be understood that the communication between the consumer and user has taken place within the established period.

CANCEL ORDER:

If the cancellation of the order arrives before the merchandise is shipped, the customer will not have any costs. In the case of a cancellation after the order has been shipped, the customer will be responsible for the shipping costs as well as the return costs of this same order.
